Judge May Rule on DWI Case Amid L.I. Crime Lab Woes

Cuomo appointed state inspector general to review testing procedures at shut-down lab.

A New York judge is expected to rule on whether to throw out a defendant's drunken driving conviction amid growing questions over the accuracy of results from the Nassau County crime lab.

The lab was shut down last month amid revelations that there were inaccuracies involving drug analysis. There have since been problems cited with blood-alcohol results.

Defense attorney Brian Griffin is trying to get his client's 2010 conviction on aggravated vehicular assault and DWI tossed. He says the results of his client's tests, as well as those of other defendants, cannot be trusted.

Nassau County Judge George Peck is expected to rule Monday afternoon.

If he tosses the conviction, it could set the stage for other defendants to seek exoneration.
