A Queens man whose murder conviction was overturned has been released after spending more than 16 years in prison.
Tullie Hyman was released on Tuesday.
He was convicted of killing tenant activist Maria Medina in 2002 and sentenced to 21 years to life in prison. Medina had been killed by a stray bullet during a gunfight.
Hyman turned himself in but maintained his innocence. An eyewitness later recanted her testimony.
In July, Judge Raymond Dearie vacated the conviction.
A spokeswoman for the Queens district attorney's office said they plan to appeal Dearie's ruling. If unsuccessful, she says they will then decide whether to retry the case.
The 36-year-old Hyman told the Daily News he plans to start a family with his wife, whom he married while in an upstate prison.
