Second Suspect in Brutal Hoboken McDonald's Attack Surrenders as Victim Undergoes Third Surgery for Head Trauma: Police

The second man police have been looking for in connection with a brutal Memorial Day attack at a Hoboken McDonald's that was captured by surveillance cameras surrendered to police Monday, authorities tell NBC 4 New York.

Robert Brichta, 27, of Kent, New York, is expected to face aggravated assault and endangering an injured victim charges, the same charges faced by 26-year-old suspect Paul Mailoni, also of New York, who previously turned himself in to authorities, Hoboken police said.

Brichta, who had been celebrating his birthday the weekend of the attack, was escorted to the police precinct by his parents, authorities said.

Police say Brichta is allegedly the suspect captured on surveillance video delivering a soccer-style kick to the still-unidentified victim's head during the 3:30 a.m. confrontation May 25. It's not clear what provoked the attack. There were witnesses, but no one can say what led to the attack on the unsuspecting customer, according to police. Some video suggests the men may have been drinking.

Both suspects are seen on video casually leaving the restaurant, food bags in hand, after the attack. Investigators are not releasing the video of the actual attack or identifying the victim, other than to say that his parents live in New York.

In a criminal complaint from the Hudson County prosecutor's office, the victim was described as "suffering from bleeding in the brain and had a portion of his skull removed in surgery." Police said he underwent his third surgery Monday for the head trauma suffered in the attack.

Information on Brichta's attorney wasn't immediately available. Mailoni appeared in court in Jersey City last week; it wasn't clear if he entered a plea. He is allegedly the suspect seen in the surveillance video sucker-punching the victim.
