The New Jersey Supreme Court is considering whether the state can prosecute two high school employees accused of having sex with students they were chaperoning on a class trip to Germany.
Attorneys for Artur Sopel and Michael Sumulikoski on Wednesday argued the state can't charge the men because the alleged conduct with four 17-year-old female students occurred overseas.
Prosecutors criticized what they call a "what happens in Germany stays in Germany" defense.
Sopel was vice president of operations at Paramus Catholic High School and Sumulikoski was a substitute teacher and assistant football coach during the 2011 trip. They have denied any wrongdoing.
The Record reports much of the arguments before the state's highest court centered on the state's definitions of criminal conduct and territorial jurisdiction.
