No Prosecution in Upper West Side Jaywalking Arrest

The elderly Manhattan man who claimed that he was injured by police officers during a jaywalking arrest earlier this year won't face prosecution, according to a family representative.

Elizabeth OuYang, president of the Justice for Kang Wong Committee, said that the Manhattan DA decided not to pursue charges against 84-year-old Kang Wong, who was arrested Jan. 19 after crossing West 96th Street.

Wong's family released a statement saying they were gratified with the decision.

The Manhattan DA's office declined comment Wednesday. 

Wong is suing the NYPD and the city for $5 million in the arrest. His suit alleges that officers pushed the 84-year-old against a wall, beat him and threw him to the ground, causing him to lose consciousness. Wong said he was hospitalized for his injuries and was bleeding from the head.
