A 43-year-old man has been convicted of raping and sexually assaulting a woman while her 5-year-old son watched TV in another room, authorities said Tuesday.
Victor Cruz Garcia was convicted of first-degree rape and first-degree criminal sexual act on Friday, about 16 months after the attack, the Putnam County District Attorney's Office said.
When the woman broke free following the rape, she crouched behind a door with her son as Cruz Garcia threw food and bottles of alcohol at the door and threatened to harm the woman and her family if she reported the attack, prosecutors said.
Putnam County District Attorney Adam Levy expects to ask for the maximum sentence of 50 years in prison, he said.
