Sex Offender Caught Rubbing Privates on Woman at Times Square Station Week After Getting Out of Prison: Police

What to Know

  • A woman in her 20s was waiting for a subway train at the 42nd Street-Times Square station when a man came up to her, police say
  • The man, identified as Heriberto Torres, allegedly rubbed his exposed privates on the woman's rear end
  • Plain clothes officers took Torres, a sex offender with prior arrests, into custody

A sex offender with a string of prior arrests who had just gotten out of prison last week was in police custody again Wednesday night after cops say he rubbed his genitals on a woman as she was getting onto a train at a Times Square subway station.

Heriberto Torres, 66, is facing a number of charges, including persistent sex abuse, sex abuse, resisting arrest, forcible touching and public lewdness.

Police say two plainclothes officers were at the 42nd Street-Times Square station around 6 p.m. Wednesday when they noticed Torres position himself behind the 20-something-year-old woman on a subway platform.

As the woman was getting onto a northbound 3 train, Torres took out his penis and repeatedly rubbed it on her rear end, police said.

Torres allegedly flailed his arms when officers tried to arrest him.

Police said Torres is a level three sex offender with 13 prior arrests, including three for sex abuse or forcible touching. He has to have life-time monitoring and was wearing a GPS ankle monitor at the Times Square station on Wednesday night. Authorities say he was just released from prison last week, where he had been serving time for another sex crime.

It wasn’t immediately known if he had an attorney who could comment on the allegations.
