Drunken 78-Year-Old Woman Crashes Truck Into Daycare Center

Blood alcohol level 3x the legal limit

A 78-year-old Albany woman faces up to 3 to 9 years in prison for backing her truck at high speed into a daycare center while she was drunk, seriously injuring a woman who was in her path.

Albany County District Attorney David Soares says Marion Albert pleaded guilty to multiple felonies including vehicular assault, driving while intoxicated and reckless driving. Sentencing is May 6.

The accident happened around 4:30 in the afternoon of Aug. 20 in the city of Albany. Prosecutors say Albert had a blood alcohol level of .25 percent -- three times the legal limit -- when she backed out of her driveway and floored it across the street.

The truck crushed a woman and rammed through the wall of the daycare center into a room full of infants. No children were hurt, but the woman suffered a broken femur and hip requiring ongoing treatment.
