Construction Company Convicted in Death at NYC Building Site

A construction company in charge of a New York City building site has been convicted of manslaughter in the death of a worker in a trench collapse.

The company, Harco Construction LLC, was also convicted Friday of criminally negligent homicide and reckless endangerment in the April 2015 death of 22-year-old Carlos Moncayo.

The Ecuadorean emigrant died when a 14-foot trench caved in at a building site in Manhattan.

Under city building code, trenches deeper than 5 feet are supposed to be fortified.

Manhattan District Attorney Cyrus Vance says the conviction will send a message that contractors aren't insulated from criminal prosecution in a worker's death.

Harco faces fines of up to $35,000 at sentencing scheduled for July 13.

Criminal cases are still pending against an excavation subcontractor and two individuals.
