Atlantic Yards Is Back in Court Again

The Atlantic Yards project was back in court yesterday, this time for the appeal of a lower court decision rejecting a challenge to the environmental review in the case. The hearing was in front of a panel of five appellate judges. Will the court reverse course or affirm the original decision? Develop Don't Destroy continued to express optimism say the judges were "extremely skeptical" of the state's case. Interestingly, if it upholds the dismissal, it can be appealed to New York's highest court, the Court of Appeals. That, in turn, means that the lawsuits will continue longer. This case is not to be confused with the Eminent Domain challenge. That was rejected by the U.S. Supreme Court, but is being argued in New York State court as well. The lawsuits could be concluded next year. Or not.
