Man Who Videotaped McDonald's Gang Assault Arrested for Inciting Riot: NYPD

Police say a man who videotaped an alleged gang assault inside a McDonald's restaurant in Brooklyn has been arrested, accused of inciting riot. 

The suspect, identified as 24-year-old Amir McCants, was charged with means to promote or incite a riot.

"If you heard the audio, it's pretty evident what he was doing," said NYPD Chief of Detectives Robert Boyce, referring to the clip in which a man is heard saying: "Kill him, kill him."

Police said several young people attacked a 43-year-old man at the restaurant on Flatbush Avenue at about 2 p.m. Thursday when he attempted to stop a fight between two teenage girls.

McCants allegedly urged the attackers to continue beating the victim by repeatedly screaming "kill him," police said.

McCants never threw a punch, and he wasn't arrested for shooting the video, according to police. Instead, his violent words were allegedly inciting a riot.

Attorney information for McCants wasn't immediately clear. As he awaited arraignment Tuesday night, his cousin, Mike Moore, told NBC 4 New York outside court, "He's a very good person. He's very intelligent, a good guy, he stays out of trouble."

McCants is the third person to be arrested in the attack; an 18-year-old man and a 16-year-old girl from East New York were arrested Saturday.

"New York penal code law says you have to have four people to incite a riot," said Boyce. "We have three right now, and we're looking for a fourth one."

The fourth person, a shirtless male seen in the video hitting the victim, was identified and arrested Wednesday, police said. The 17-year-old boy faces a gang assault charge. 

The victim was taken to the Brooklyn Hospital Center where he was treated for bruises to his face, head and torso.
