Jury Stuck on Rape Counts vs. Off-Duty NYPD Officer

Jurors said Monday they were stuck on the rape and some other charges against Michael Pena.

A jury is struggling to decide whether an off-duty NYPD officer who admitted sexually attacking a 25-year-old schoolteacher also raped her.     

Jurors said Monday they were stuck on the rape and some other charges against Michael Pena. They say they've reached a verdict on other charges, including three counts of predatory sexual assault.

That's the top charge and is punishable by up to life in prison. They did not announce a partial verdict.     

Manhattan state Supreme Court Justice Richard Carruthers told the jurors to continue deliberating.     

The woman testified that Pena raped and molested her after grabbing her off the street, ordering her into a courtyard and threatening to shoot her.     

Pena's lawyer admitted the officer attacked the woman but said he never managed to have intercourse.
