NY Court Weighs Crime Level for Sex With Undisclosed HIV

New York's highest court is considering whether having unprotected sex without telling your partner you have the virus that causes AIDS constitutes reckless endangerment in the first degree, a felony showing "depraved indifference" to another's life.

The Court of Appeals is weighing whether lower courts correctly reduced Terrance Williams' charge to second-degree reckless endangerment, a misdemeanor, after concluding that he cared "much too little" about his partner, who got infected, but that the evidence didn't show that he "did not care at all."

Syracuse prosecutors argue that despite medical advances, the human immunodeficiency virus can lead to AIDS and kill victims, and Williams told his partner four different times it was OK not to use protection.

A court ruling is expected next month.
