Man Arrested in Alleged Rape of 16-Year-Old Girl Won't Be Prosecuted: DA

The Bronx district attorney's office says it is declining to prosecute the 62-year-old man arrested for allegedly posing as a maintenance worker and raping a 16-year-old girl in her apartment, police say.

Jose Nallar was arrested at his home early Wednesday on charges of rape, burglary and unlawful imprisonment in the attack at the teen's apartment in Tremont Tuesday afternoon. 

By midday Wednesday, prosecutors said they would not be prosecute him. The district attorney's office declined to give a reason for their decision. 

Nallar couldn't immediately be reached for comment on the arrest.
