Man Files Claim Against NYPD Following Harlem Gun Battle

A bystander who took a bullet to the thigh during a police shootout with another man at a New York City block party says he's planning to sue police for $20 million.

Larry Garlick filed a pre-lawsuit document called a notice of claim on Wednesday. City lawyers say they will review the claim.

Police said they fired a total of 46 bullets after a man shot at an officer early Sunday. In a hail of police and other bullets, that man was shot 21 times. An acquaintance he'd been fighting was killed.

One officer was shot in his bullet-resistant vest. Another was grazed.

It's unclear whether Garlick was shot by police or another gunman. His lawyer, Bruce Baron, says police should be held responsible for their handling of the chaos.
