Long Island Man Wants Feds to Prosecute Police Beating Case

Kyle Howell's attorney says the Nassau DA hasn't recognized him as a "victim of a racially motivated beating"

A Long Island man who was punched and kicked by a police officer is asking for federal prosecutors to take over the case.

Nassau County Officer Vincent LoGiudice was charged in state court in June with felony assault for punching and kicking Kyle Howell during an April traffic stop captured on video from a nearby business. He has pleaded not guilty.

Howell's lawyer said Wednesday that the county's district attorney, Kathleen Rice, has not prosecuted the case to the fullest extent.

Attorney Amy Marion says Howell was the victim of a hate crime. She says Rice, who's running for Congress, is not recognizing Howell as "a victim of a racially motivated beating." She says additional charges should have been brought.

A Rice spokesman said there was no justification for another prosecutor.
