Judge Tosses Most Serious Charge in Cat-Kicking Case

A judge has dismissed the most serious charges against a man captured on video kicking a stray cat several yards through the air.

Andre Robinson, who was arrested in May, is no longer charged with torturing and injuring an animal after prosecutors failed to offer evidence of the cat’s injuries. According to an arrest report, the cat flew about 20 feet.

The video shows a person prosecutors allege is Robinson calling the cat over. After the cat turns around, the person kicks the cat, which flies through the air and lands on the ground. The person shown on the video then laughs.

Robinson still faces up to 90 days in jail after prosecutors added a charge of attempted animal torture and injury. The judge said the dropped charge could be restored if prosecutors return with the evidence.

The cat, named King, was taken to the ASPCA Animal Hospital by the NYPD for emergency veterinary care after the video was posted. King was adopted shortly after.
