A 6-year-old New York City girl who was struck by a car while chasing an ice cream truck has died.

Zhaneya Butcher of Queens suffered severe trauma to the head and brain on June 28, reports The New York Post.

She died on July 7.

The child was outside her grandfather's house when she started chasing the ice cream truck.

According to a criminal complaint, the driver of the car, Kent Lowrie, was charged with DUI and vehicular assault. He's being held on $25,000 bond.

Zhaneya's mother, Cherell Smith, filed a lawsuit this week against the driver and the car's owner. It seeks an unspecified amount.
