Lady Gaga Sues Excite Media over Trademark

Lady Gaga is suing Excite Media for using her name to sell cosmetics and jewelry after the marketing firm applied for a trademark of "Lady Gaga" and "Lady Gaga Fame."

According to WWD, Excite is refusing to withdraw their applications with the U.S. Patent and Trademark Office, which blocked Gaga from copyrighting her own name in the realms of beauty and jewelry. Though the PTO suspended Excite's applications, Gaga is still blocked from submitting her own application until they are completely dismissed.

The singer seeks damages and injunctive relief for any money made under the Lady Gaga name. Presumably, her claim to the name is strong enough to hold up in court over a first-come-first-serve premise — moreso than, say, Louboutin's ownership of the color red — but we'll be interested to see how Excite's sneaky move pans out in court.
